Welcome to Esther Tech Shop. These Terms of Service ("Terms") govern your use of esthersuccessstore.com (the "Site") and any purchase you make from us. By visiting the Site or placing an order, you agree to these Terms. Please read them.
In these Terms, "we", "us" and "our" mean Esther Tech Shop. "You" means the visitor or customer.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm that you meet this requirement and that the payment method you use belongs to you or that you have permission to use it.
2. Products and descriptions
We describe our products as accurately as we can, including specifications supplied to us by our manufacturers. We do not overstate performance or invent features.
Product photographs are for illustration. Colors may appear differently on different screens, and packaging may vary. Where a product listing states a limitation — for example that a feature has not been independently certified — that statement is part of the product description and you should rely on it.
Our products are consumer electronics and lifestyle accessories. They are not medical devices. Health and fitness metrics such as heart rate, blood oxygen, sleep, temperature and step count are estimates intended for general wellness and personal interest only. They are not diagnostic, they are not a substitute for professional medical advice, and they must not be used to diagnose, treat, monitor or make decisions about any medical condition. Always consult a qualified healthcare provider about your health.
3. Pricing and availability
All prices are in US dollars and are shown on the product page. We may change prices, edit product descriptions, or discontinue a product at any time without notice.
Occasionally a product may be listed at an incorrect price or with incorrect information because of a typographical or system error. We reserve the right to cancel any order placed at an incorrect price, even after the order is confirmed. If this happens we will notify you and refund you in full immediately. You will never be charged more than the price displayed when you ordered.
All products are subject to availability. If an item becomes unavailable after you order, we will contact you and offer a replacement or a full refund.
4. Orders and acceptance
Your order is an offer to buy. Our order confirmation email is an acknowledgement that we received it, not acceptance. The contract is formed when we dispatch your order.
We may refuse or cancel any order at our discretion, including where we suspect fraud, where the billing and shipping details cannot be reconciled, where a payment is declined or reversed, where an order appears to be for resale rather than personal use, or where we cannot ship to the address provided.
5. Payment
Payment is taken at checkout through Shopify Payments and the other payment providers shown at checkout. We do not store or have access to your full card details. By submitting payment information you confirm you are authorized to use that payment method.
6. Shipping, returns and refunds
Shipping timelines and costs are set out in our Shipping Policy. Returns, exchanges, cancellations and refunds are governed by our Return and Refund Policy. Both are linked in the footer of this Site and form part of these Terms.
7. Warranty and limitation of liability
Products are sold as described in their listing. If an item arrives faulty, damaged or not as described, your remedy is set out in our Return and Refund Policy — a replacement or a full refund, at your choice, within 30 days of delivery.
Beyond that, and to the fullest extent permitted by law, the Site and its contents are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.
To the fullest extent permitted by law, our total liability to you for any claim arising out of your use of the Site or a product purchased from us will not exceed the amount you paid for the product concerned. We are not liable for indirect, incidental, special or consequential losses, including lost profits, lost data, or any loss arising from reliance on health or fitness data generated by a product.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
8. Acceptable use of the Site
You agree not to use the Site for any unlawful purpose, to interfere with or disrupt its operation or security, to attempt unauthorized access to any part of it, to scrape or harvest data from it by automated means without our written permission, or to transmit any virus or malicious code.
We may suspend or terminate your access to the Site at any time if we reasonably believe you have breached these Terms.
9. Intellectual property
The Site's design, text, graphics and layout are owned by us or licensed to us and are protected by intellectual property law. You may not copy, reproduce or republish them for commercial purposes without our written consent.
Third-party brand names and trademarks that appear on this Site remain the property of their respective owners. Reference to another brand does not imply any affiliation with, endorsement by, or partnership with that brand.
10. Third-party links and services
The Site may link to third-party websites or services that we do not control. We are not responsible for their content, accuracy, or privacy practices, and including a link does not mean we endorse them. Your dealings with any third party are between you and them.
11. User feedback and submissions
If you send us reviews, comments, photographs, suggestions or other material, you grant us a non-exclusive, royalty-free right to use, reproduce and publish it in connection with our business, including on this Site and in marketing. You confirm the material is yours to give and does not infringe anyone else's rights. We may edit for length or clarity, and we may decline to publish anything.
We do not publish fake reviews and we do not remove genuine reviews simply for being critical.

13. Changes to these Terms
We may update these Terms at any time by posting a revised version on this page. The version in effect when you place an order is the version that applies to that order. Please review this page periodically.
14. Governing law
These Terms are governed by the laws of the United States and the State of New York, without regard to conflict of law rules. Any dispute will be brought in the courts of the State of New York, and you and we each consent to that venue. This does not remove any consumer protection rights available to you in your state of residence.
15. Severability and entire agreement
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions stay in full force. These Terms, together with our Return and Refund Policy, Shipping Policy and Privacy Policy, form the entire agreement between you and us regarding the Site and your purchases.
